OPS SPORTS ACADEMY

Waiver of liability and
assumption of risk agreement

1.

Entering OPS Sport Academy shows that you knowingly and freely assume all risks, both known and unknown and hold yourself fully responsible.

All participants must have their own medical insurance cover and take the court at their own risk. Any injuries or death sustained to a participant whilst participating in any OPS Sport Academy activity is not the fault or responsibility of the organizers nor the venues.

All participants (Teams, players, coaches, staff and fans) grant OPS Sport Academy irrevocable, unrestricted, worldwide, exclusive license to use and to license the use of the photos and videos taken during the OPS Sport Academy events or activity and to sub-license those rights to others. The individuals acknowledge and agrees that no payment by way of license fee or compensation will be payable by OPS Sport Academy to such individuals. Photos and videos taken can be used by OPS Sport Academy for advertising and marketing purposes.

a. All players grant OPS Sport Academy permission to publish players profiles on OPS Sport Academy site which is visible to the public. The player profile will include the player photo, jersey number, name, age and statistics of games played.

The risk of injury for the sports activities in OPS Sport Academy is significant including the potential for permanent paralysis or death, while rules, equipment and personal disciplines may reduce this risk, the risk of serious injury does exist. Physical activities and gathering may expose you to COVID-19 and Other viruses from unknown individuals or sources, even with all the precautionary measures taken by OPS Sport Academy and venues that host the activities. You knowingly and freely assume all such risks, both known and unknown and assume full responsibility of participation.

Any damage caused to the facility or to the equipment by an individual is that individual responsibility to repair and will be invoiced to the individual that caused the damage. (An official evaluation will be invoiced to fix any damage)

Any violent, threatening or abusive act from any individual is not permitted and will result in an automatic suspension. Players must respect all organizers and Coaches. Suspensions will vary after considering the situation and can lead to an indefinite ban.

In reference to point 4 above, Fees will not be refunded.

Fees paid are not refundable and valid only for the relevant season.

I acknowledge the contiguous nature of COVID-19 and Other Viruses and voluntarily assume the risk that my family, including child(ren), and i may be exposed to or infected by COVID-19 and other viruses while on site at the venue and that such exposure or infection may result in personal injury, illness, permanent disability and death. I understand that the risk of becoming exposed to or infected by COVID-19 and Other viruses at the venue may result from the actions, omissions, or negligence of myself, and others, including but not limited to, OPS Sport Academy, the venue management, company's employees, volunteers and program participants and their families. 

 

I voluntarily agree to assume all of the forgoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability and death), illness, damage, loss, claim, liability, or expense, of any kind, that i, my family and my child(ren) may experience or incur in connection with my child(ren)'s attendance at the venue or participation in sports activities ("Claims").

 

On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless OPS Sport Academy, the venue management company and their employees, agents and representatives, of and from the claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of OPS Sport Academy, the venue management company and their employees, agents and representatives, whether a COVID-19 and other viruses infection occur before, during, or after participation in sports facility activities.

Academy, Leagues and other sessions can be called off due to force majeure. In which case, services may be suspended or cancelled indefinitely. Academy packages will be credited for future use within the assigned deadline.

 

a. Noting point 8 above, OPS Sport Academy shall not be liable to the players or members of the academy for any delay or non-performance of its obligations arising directly from any of the following cause or causes beyond its reasonable control and unable reasonably to be planned for or avoided: an act of God, a governmental act, an act of terrorism, war, pandemic, an earthquake, a flood, an embargo, riot, sabotage, a strike (other than of its own employees), a failure of third party telecommunications networks, failures of third parties, any explosion or civil commotion (each a Force Majeure Event).

⁠Academy sessions are valid for the duration of the packages chosen. Any unused sessions will expire after the assigned package date. No credit or refund will be given if a client did not attend a session. All sessions must be used by the deadline assigned to them or lost.
